This includes any health-related information and records we have about you and the health care services you receive at our facility. PHI is any information that could identify you and is related to your past, present, or future physical or mental health or condition, as well as the health care services you receive. This Notice of Privacy Practices outlines how we may use and disclose PHI for treatment, payment, health care operations, and other purposes allowed or required by law. Additionally, it explains your rights to access and control your PHI. Therapies Leading Care, its affiliates, associates, and personnel will adhere to this policy. Coroners, Funeral Directors, and Organ Donation: Your PHI may be disclosed to a coroner or medical examiner for identification purposes, determining cause of death, or other legally authorized duties. Additionally, your PHI may be used and disclosed for cadaveric organ, eye, or tissue donation purposes.
Research: Your PHI may be disclosed to a researcher if their research has been approved by an institutional review board that has established protocols to ensure the privacy of your PHI. If the researcher will have access to your identifiable information, such as your name and address, we will ask for your permission.
Military Activity and National Security: Your PHI may be used or disclosed as required by military command authorities for U.S. Armed Forces members, for determining benefits through the Department of Veteran Affairs, and for foreign military personnel to the appropriate foreign military authority. We may also disclose your PHI to federal officials for national security, intelligence activities, protective services to the president, and other activities authorized by law.
Workers’ Compensation: We may use and disclose your PHI as necessary to comply with laws related to workers’ compensation or similar programs established by law.
Incarcerated Individuals: If you are incarcerated, we may disclose your PHI to the correctional institution or its agents as necessary for your health and the health and safety of others.
Others Involved in Your Care: We may disclose your PHI to family members, close friends, or others you identify who are involved in your care or payment for your care, unless you object.
Other Uses and Disclosures: We will only use or disclose your PHI with your written authorization, except as permitted or required by law. You may revoke your authorization in writing at any time, and we will no longer use or disclose your PHI except to the extent that we have already acted in accordance with the authorization.
Your Rights Regarding Your Health Information
Right to Inspect and Obtain a Copy: You have the right to inspect and receive a copy of your PHI that we use to make decisions about you, as long as we maintain the information. If we do not keep the health information you requested but we know where it is maintained, we will let you know where to send your request. You must submit a written request to inspect and/or receive a copy of your records. We may charge you a reasonable fee to fulfill your request, as allowed by federal or state law. We may deny your request to inspect and/or copy your records in certain limited circumstances under federal law. If we deny you access to your records, you may request a review of the denial. Someone other than the person who denied your request will conduct the review.
Right To Request Restrictions: You have the right to request that we do not use or disclose certain parts of your PHI for treatment, payment, or health care operations. You can also request that specific parts of your PHI not be shared with family, relatives, or friends who are involved in your care or payment for your care, or for notification purposes as described in this Notice of Privacy Practices. We may not be able to fulfill your restriction request, except if such disclosure is not required by law and made to a health plan for payment or health care operations, and you have paid for the services in full and out of pocket. If we agree to your requested restriction, we will honor it unless the information is required to provide emergency treatment. To request a restriction, please contact our Compliance Officer.
Right To Request Confidential Communication: You can request that we send you confidential communications about your medical matters through alternative means or to an alternative location. We will accommodate all reasonable requests without asking for an explanation from you. To make such a request, please contact our Compliance Officer.
Right To Amend: You have the right to request an amendment of your PHI if you believe that it contains incorrect or incomplete information. To request an amendment, you must send a written request to our Compliance Officer, including a reason that supports your request. We may deny your request for amendment if you ask us to amend information that: 1) we did not create, unless the person or entity that created the information is not available to make the amendment; 2) is not part of the health information that we keep; 3) you would not be permitted to inspect and copy; or 4) is accurate and complete.
Right To Receive an Accounting of Disclosure: You have the right to receive an accounting of the disclosures we have made of your PHI for purposes other than treatment, payment or health care operations. An accounting of disclosures made through an electronic health record will also account for disclosures for treatment, payment and health care operations purposes during the three years prior to your request, at such time as the secretary of the U.S. Department of Health and Human Services provides regulations addressing this requirement. It may also exclude any disclosures made based on your written authorization and a limited number of special circumstances including for national security, law enforcement, and correctional institutions. To obtain this account, you must submit your request in writing to our Compliance Officer, stating the time period for which you want an accounting and not including dates more than six years prior to the request. The right to receive an accounting is subject to certain exceptions, restrictions, and limitations.
Right To Obtain a Paper Copy of This Notice: You have the right to obtain a paper copy of this notice upon request, regardless of whether you have already agreed to receive it electronically.
Right to Be Notified of a Breach: You also have the right to be notified in case of a breach of your unsecured health information.
Changes to This Notice: We reserve the right to modify the terms of this notice, and any changes will be effective for the health information we currently maintain as well as any future information we obtain about you. We will post the current notice with the effective date at all our facilities and on our website.
Complaints: If you believe that your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. You will not face retaliation or any penalty for filing a complaint.

In instances where it is necessary, Therapies Leading Care provides free auxiliary aids and services to patients with disabilities, including oral interpretation or information in alternate formats, to facilitate communication with their therapists and to ensure meaningful access to Therapies Leading Care services. Additionally, Therapies Leading Care offers free language services, such as oral interpretation or translation of written information, to patients with limited English proficiency, to ensure meaningful access to Therapies Leading Care services. Please contact the Therapies Leading Care therapist if you require these services. If you believe that Therapies Leading Care has discriminated against you on the basis of race, color, national origin, age, disability, or sex, please communicate your grievance through mail, phone call, fax, or email to one of our therapists as soon as possible.
